Welcome to LusyChat ("LusyChat", "we", "our", or "us"). These Terms of Use (the "Terms") govern your access to and use of the website lusychat.ai and any related applications, features, content, and services we make available (collectively, the "Service").
By accessing or using the Service in any way — including by browsing, registering an account, generating content, submitting prompts, uploading materials, or purchasing a subscription — you agree to be bound by these Terms. If you do not agree, you must not access or use the Service.
IMPORTANT — ADULTS ONLY. The Service is an adult-oriented platform that uses artificial intelligence to generate sexually explicit, romantic, or otherwise mature content. The Service is intended exclusively for users who are at least 18 years old (or the age of majority in your jurisdiction, whichever is greater). By using the Service you represent and warrant that you meet this requirement. If you are a minor, you must leave immediately.
To access or use the Service you must (a) be at least 18 years of age and the age of majority in your place of residence; (b) have full legal capacity to enter into a binding agreement; (c) not be located in, or a national or resident of, any jurisdiction in which the Service is prohibited; and (d) not have been previously banned from the Service.
When you create an account you affirm, under penalty of perjury, that you are 18 or older and that all registration information you provide is true, accurate, and complete.
KYC and identity verification. We require, or may at our discretion require at any time, that you complete identity- and age-verification ("KYC") through our third-party verification partner, Sumsub, or another reputable verification vendor we designate. KYC may be required to (i) access certain adult-oriented features, (ii) purchase subscriptions or credits above a threshold we may set from time to time, or (iii) where required by applicable law in your jurisdiction.
The KYC process typically involves (a) capture of a valid government-issued photo identification document (such as a passport, national ID card, or driving licence), (b) a live selfie with liveness and anti-spoof detection, (c) automated face-match between the ID photograph and the live selfie solely for the purpose of the verification check, and (d) extraction of your date of birth to confirm you are at least 18 years of age. The live selfie is used only to complete the verification step and is not retained as a user-facing avatar or reference image. You consent to the collection, processing, and sharing of these data with Sumsub (or our designated alternate vendor) for the sole purpose of completing the verification. Our handling of KYC data is described in our Privacy Policy; the vendor processes data as an independent controller under its own privacy notice (https://sumsub.com/privacy-notice/).
We may refuse to onboard, suspend, or terminate any user who (i) fails or refuses KYC, (ii) submits forged, altered, or otherwise invalid identification, (iii) is detected by our vendor or our systems as a likely minor, or (iv) is otherwise ineligible. Knowingly providing false age or identity information is a material breach of these Terms, may give rise to civil and criminal liability, and may be reported to the Malta Police Force, Sumsub's fraud-intelligence network, and other competent authorities.
LusyChat is an AI-powered adult companion platform delivered as a text-and-voice chat product. Through the Service, registered users may, among other things:
The Service does not offer on-demand image generation, on-demand video generation, "undress" or "nudify" functionality. The Service does not feature, broadcast, or distribute live performances of real human performers, and does not host real-person nude or explicit imagery or third-party adult content libraries.
ALL AI CHARACTERS ARE ENTIRELY FICTIONAL. THEY ARE NOT REAL PEOPLE, AND ANY RESEMBLANCE TO ANY ACTUAL PERSON, LIVING OR DEAD, IS UNINTENDED AND COINCIDENTAL.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must immediately notify us at contact@business.lusychat.ai of any unauthorized use. We are not liable for any loss or damage resulting from your failure to safeguard your credentials.
You may not (a) share your account, (b) create more than one account except with our written permission, (c) use another user's account, (d) create an account using automated means, or (e) sell, transfer, or assign your account.
Subject to your continued compliance with these Terms, LusyChat grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal, non-commercial enjoyment. All right, title, and interest in and to the Service, including all software, models, character assets, branding, and underlying technology, remains the exclusive property of LusyChat and its licensors.
"User Inputs" means the text and selections you submit through the Service, including chat messages, character-configuration fields (such as name, personality traits, backstory, conversation style, and content preferences), avatar selections from our pre-curated library, voice-profile selections from our licensed library, and any feedback, abuse reports, or support communications you send to us. The Service does not accept file uploads of any kind — no images, no photos, no selfies, no audio or voice samples, no video files. There is no mechanism on the Service to upload a face, a voice recording, or any other media of any person.
You retain ownership of original text you write. By submitting User Inputs you grant us a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to host, store, reproduce, adapt, process, transmit, and display those User Inputs for the limited purpose of operating, securing, improving, and moderating the Service. We do not use private User Inputs to train our shared or general-purpose AI models.
You represent, warrant and covenant that, for every User Input you submit:
We reserve the right, but are not obligated, to review, refuse, modify, restrict, or remove any User Input at any time, with or without notice. Our refusal or removal of User Inputs does not create any liability on our part.
Output produced by our AI in response to your inputs ("Generated Output") consists of text chat messages and synthetic-voice renditions of those messages, delivered to you for personal, non-commercial enjoyment, subject to these Terms and our Content Policy. The Service does not generate images or video. To the extent that any rights in Generated Output vest in us, we assign you a non-exclusive, perpetual licence to use the Generated Output for lawful personal purposes. We make no warranty that Generated Output is unique, copyrightable, accurate, or fit for any particular purpose.
Generated Output is voiced by, and refers to, fictional AI characters. You agree not to (a) represent Generated Output as the speech, statement, or likeness of a real person, (b) combine Generated Output with the name, image, or voice of any real person, (c) use Generated Output to harass, defame, blackmail, or impersonate anyone, or (d) redistribute Generated Output in any commercial setting without our prior written permission.
You agree not to use the Service to create, request, upload, store, distribute, or otherwise process any content that:
Violations of this Section 7 may result in immediate termination, forfeiture of unused credits, account bans across all of our properties, and — for unlawful content — referral to NCMEC, INHOPE, the Internet Watch Foundation, the Malta Police Force, and any other competent authority.
Certain features of the Service are available only to paying subscribers or require the purchase of credits. Payment is processed by our third-party payment provider, who acts as the merchant of record. By submitting payment information you authorize the provider and us to charge the applicable amount, including any taxes and recurring renewal fees.
Subscriptions auto-renew at the end of each billing period at the then-current rate until cancelled. You may cancel at any time through your account settings; cancellation takes effect at the end of the current paid period. Except where required by law, all sales are final and fees are non-refundable. Bona-fide billing errors should be reported to contact@business.lusychat.ai within thirty (30) days; we will investigate in good faith and may issue a refund or credit at our discretion.
Chargebacks made without first attempting to resolve the dispute with us may result in account termination and forfeiture of any remaining balance.
All software, models, designs, text, graphics, logos, character templates, and other materials provided as part of the Service are owned by LusyChat or its licensors and are protected by copyright, trademark, and other laws of Malta, the European Union, and other jurisdictions. Except for the limited license granted in Section 4, no rights are granted to you under these Terms.
We respect intellectual-property rights. If you believe content on the Service infringes your copyright, please follow the procedure set out in our DMCA Policy. We respond to properly submitted notices and maintain a policy of terminating, in appropriate circumstances, accounts of repeat infringers.
If you appear in content on the Service without your consent, or if you wish to have content depicting you removed, please follow the procedure described in our Content Removal Policy. We treat such requests as a priority and will act expeditiously upon verification.
Our processing of personal data is described in our Privacy Policy, which forms part of these Terms. By using the Service you acknowledge that you have read and understood the Privacy Policy.
The Service may contain links to third-party websites or services that we do not control. We are not responsible for the content, policies, or practices of any third-party site. Your dealings with third parties are solely between you and the third party.
THE SERVICE AND ALL CONTENT — INCLUDING GENERATED OUTPUT — ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT GENERATED OUTPUT WILL MEET YOUR EXPECTATIONS. AI-GENERATED MATERIAL MAY BE INACCURATE, OFFENSIVE, OR UNEXPECTED; YOU USE IT AT YOUR OWN RISK.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL LUSYCHAT, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) EUR 100. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
You agree to defend, indemnify, and hold harmless LusyChat, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from (a) your use of the Service, (b) your violation of these Terms, (c) your User Content, or (d) your violation of any law or third-party right.
We may, at our sole discretion and without notice, suspend or terminate your access to all or part of the Service, delete your account, and remove any User Content or Generated Output, where we reasonably believe that you have violated these Terms, posed a risk to other users, or where required by law or by a regulator, payment partner, or law-enforcement authority. Sections that by their nature should survive termination will survive.
We may change, suspend, or discontinue any part of the Service at any time. We may also modify these Terms; if we make material changes we will provide reasonable advance notice (for example, by posting an updated date or sending an email). Your continued use of the Service after the new Terms take effect constitutes acceptance of the changes.
These Terms are governed by the laws of Malta, without regard to its conflict-of-laws rules. The Courts of Malta have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Service, save that nothing in this clause prevents a consumer resident in the European Union from bringing proceedings in the courts of their country of residence where mandatory consumer-protection law so permits.
Consumers resident in the European Union may submit complaints to the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. We do not commit to and are not obliged to use an alternative dispute-resolution body to resolve disputes with consumers.
These Terms, together with the Privacy Policy, Content Policy, Content Removal Policy, DMCA Policy, and 2257 Statement, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements. If any provision is held invalid or unenforceable, the remaining provisions will continue in full force. Our failure to enforce any right is not a waiver. You may not assign these Terms; we may assign them at any time. Notices to you may be posted on the Service or sent to the email associated with your account.
